DIGITAL SOCIETY’S LAW: TOWARDS A NEW SOCIOLOGICAL AND LEGAL ENLIGHTENMENT

Abstract

The emergence of the press and industry eroded the stratified society of old Europe and led to functional differentiation. Today, the very boundaries among law, politics, media and economy are under pressure from digital means of communication dissemination and from artificial intelligence. Which are the institutional configurations and programming strategies of a law capable of expanding social complexity and contingency, transforming the dangers of new technologies into manageable risks? This article poses such a question and reflects on it from social systems theory.
