THE CIRCULARITY OF FUNDAMENTAL RIGHTS: AN AUTOPOIETIC OBSERVATION

This essay has as its object of study the analysis of fundamental rights from the perspective of the theory of autopoietic social systems. The objective of the study is to present a new approach to Luhmann's ideas, highlighting autopoiesis in social systems as a gradual and specific phenomenon of Law, in contrast to Luhmann's radical vision. Furthermore, the essay seeks to demonstrate how the legal system perceives fundamental rights, exploring the ability to use the system's paradoxes creatively to ensure its continuity. The results/conclusions of this study indicate the viability of applying Luhmannian theory in peripheral countries of global society. It also seeks to demystify misconceptions related to autopoiesis and the author, Luhmann, often spread by Brazilian jurists.
