LEGAL PLURALISM AND THE RIGHTS OF MINORITIES (In memory of Manuel Calvo García)

Abstract

The article deals with the relationship between legal pluralism and minority rights. First, It critically considers the perspective of formalist positivism, for which only state law is true law, and points out the analytical-methodological convenience of recognising the legal character of other systems of rules, such as those emerging from the normative and jurisdictional practices of minority groups. Second, and from a normative perspective, it studies multicultural proposals that favour the recognition of minority forms of normative production and jurisdiction. In the author’s view, this recognition is possible only if human rights of members of minority groups are respected.
